FERRY & EUROTUNNEL BOOKINGS

The following Booking Conditions and the General Information form the basis of the contract between you and Ferrybooker.com which acts as agent for travel and accommodation providers who have agreed to be bound by these terms. Please read this information carefully before booking your holiday as they set out our respective rights and obligations. Telephone bookings are only accepted on the assumption that you have read and agree to these booking conditions. Your contract with us and all matters arising from it are governed by English Law and the courts in England shall have exclusive jurisdiction. A contract exists when we issue a Confirmation Invoice on behalf of the travel and accommodation providers.

YOUR COMMITMENT TO US

Booking, Deposit and Payment. Once you have decided upon your route, date and approximate time of your outward and return travel, along with any accommodation and/or insurance requirements (if applicable), then call to make your reservation request. You will be asked to pay the holiday deposit of £50 per person (including children), plus insurance premiums in full.

The balance of the holiday cost must be received by us not less than 8 weeks before departure. We do not send out reminders. If you paid your deposit by credit card, the balance will be automatically deducted 8 weeks before departure unless we have received payment by other means by this date. Credit card charges of 1.25% apply for deposits and balances. Alternatively you may post us a cheque for your deposit/balance or pay by Switch or Delta to avoid these charges.

If we do not receive full payment on time, we reserve the right to treat your booking as cancelled by you and the scale of cancellation charges described below will apply. If your booking is made within 8 weeks of departure then full payment must be made at the time of booking. Money paid to a Travel Agent is held by him on our behalf.

All accommodation is offered subject to restricted availability and on a first-come first-served basis. Flight seats, Eurostar seats and Channel crossings are subject to availability and schedules are subject to change without notice. The number of places available on any flight, train or ferry is restricted and it is possible that places may be fully booked even though places may still be available for sale in a different booking class on the same service. In the event that your travel cannot be satisfied due to lack of availability or service on the requested dates, we reserve the right to offer similar travel on alternative dates with the same or an alternative carrier. In the event that we are unable to confirm your booking immediately, we will willingly request your transportation and/or accommodation requirements extra to our allocation.

However, we will require full payment prior to making such requests as you will be committed to our booking conditions (and cancellation/amendment terms) as soon as we secure the requested services. In cases where we are unsuccessful in securing the requested services according to your requirements, we will immediately refund all monies in full.

Your Contract.

For all services we act only as your agent and your contract for travel and accommodation will therefore be with the relevant supplier. This comes into existence when we issue your holiday Confirmation Invoice.

Changes by You.

If you wish to alter any details of your booking once we have sent the confirmation, we will do our utmost to help provided changes are sent in writing to us, Recorded Delivery. Where we can make the change requested, we charge a £30 amendment fee. Changes cannot be made within 2 weeks of departure. If we are unable to make any requested change and you do not wish to continue with the booking then our cancellation charges, as detailed below, will apply. Please note that Eurostar reservations and flights cannot be changed after a reservation has been made and any alteration request will incur a 100% cancellation charge.

Cancellation by You.

If you wish to cancel your holiday in whole or in part after your booking has been confirmed, you must write to us straight away, using Recorded Delivery. Your notice of cancellation is effective from when we receive it in writing. If you do cancel, we will charge a cancellation fee on the following scale:

No refunds will be made on insurance premiums under any circumstances. If the reason for cancellation is covered by your holiday insurance policy you should make a direct claim to the insurance company.

OUR COMMITMENT TO YOU

Changes or Cancellations by Us. In the unlikely event that we will have to make any changes to your holiday we will advise you at the earliest opportunity. Most changes, if they occur, will be minor. Should the change be of a major nature i.e. travel departure delay of more than 12 hours and/or a downgrade of accommodation and/or relocation of holiday to a different region, you will have the choice of the following:

a. accepting the change or
b. accepting another available holiday from us at the appropriate price or
c. cancelling your holiday

If you choose a. or b., we will pay reasonable compensation as shown below. If you choose c., we will refund you all the money you have paid plus reasonable compensation on the scale shown below:

Important.

Compensation will not be payable for minor changes or if we are forced to cancel or in any way change your holiday due to war, riot, civil or nuclear disaster, fire or adverse weather conditions, industrial disputes, closure or congestion of ports or airports; or as a result of unusual and unforeseeable circumstances beyond our control amounting to force majeure.

Guaranteed NO Surcharges.

The price of your holiday is fully guaranteed and will not be subject to any surcharges. All holiday prices have been calculated on the basis of an exchange rate of £1.00 = 1.38 euros and VAT (which is included). We reserve the right to revise prices for new bookings in the event of any change. The price we confirm at the time of booking is the price you pay. (Please note local taxes can be introduced in holiday areas at any time and payment would be your responsibility.)

Our Responsibility.

We have exercised care in making arrangements for your holiday and described the elements of your holiday in accordance with our latest information, at the time of producing any written confirmation. Should any changes occur in descriptions of these elements, after the time of producing such written information, we will notify you when you make your booking. We accept responsibility should the services we are contractually bound to provide prove deficient or not of a reasonable standard, and for the acts and/or omissions of our employees, agents, sub-contractors, and/or suppliers, except where personal injury, illnesses or death results to the signatory to the holiday contract and/or any other person named on the booking form. Our liability under this paragraph is limited to the holiday price of the person(s) affected in total.

Furthermore, where services are provided by any air, sea or rail carrier and/or accommodation supplier, our obligations are limited in the manner provided by international conventions in respect of these carriers and suppliers. If you or any member of your party suffer death, bodily injury or illness arising from negligent acts or omissions of our employees, agents, suppliers (other than air, rail and sea carriers performing any domestic, internal or international carriage of whatsoever kind for whom we accept no liability), their sub-contractors, servants and/or agents, we will accept responsibility, provided that they were acting within the scope of, or in the course of their employment when the accident occurred, and where the failure to perform or improper performance was due to the fault of such person and not to an event which such person could not foresee or forestall even if they had taken all due care.

In return, you must notify us of your claim within 28 days of your scheduled date of return, agree to assign to ourselves or our insurers any rights you have against any third party relating to the claim, and agree to give us your full cooperation if either ourselves or our insurers wish to enforce any rights against the third party in respect of your claim.

If you or any member of your party suffer death, illness or injury whilst overseas arising out of activity which does not form part of the holiday arranged through us, we shall, at our discretion, offer advice and assistance to help you in resolving any claim you may have against a third party provided we are advised of the incident within 90 days of the occurrence.

Where legal action is contemplated, our authority must be obtained prior to commencement of proceedings and be subject to your undertaking to assign any costs recovered or any benefits received under an appropriate insurance policy to ourselves. Our costs in respect of the above on behalf of you and your party shall not exceed £5000 in total. You agree to indemnify us against all losses and/or damage arising directly or indirectly from any act, default or omission of yours.

Conditions of Carriers and Suppliers.

Many of the services which make up your holiday arrangements are provided by independent carriers and suppliers. Those carriers and suppliers provide these services in accordance with their own terms and conditions which may limit or exclude their liability to you, usually in accordance with International Conventions. Copies of the relevant terms and conditions are available by prior arrangement from ourselves. You and your party undertake to abide by the regulations of accommodation owners, carriers and other suppliers during your holiday and take precautions for your own safety.

We reserve the right to terminate the holiday contract, without notice, of anyone who, in our opinion, behaves in such a way as to cause danger, distress or annoyance to anyone or damage to property. Refunds or expenses will not be payable by ourselves in such circumstances and we will not have further responsibility towards such persons. Furthermore, the whole party will be responsible for paying us for any direct or indirect damage, loss, expense or cost you or any member of your party causes. Holiday details are issued on the sole responsibility of Ferrybooker.com.

It is not issued on behalf of and does not commit the carriers mentioned in it or any other carrier whose services are used. Tickets are issued as part of a total package and partial refunds cannot be considered in any circumstances. Tickets are not interchangeable between carriers. Open dated return tickets will not be issued. Ferrybooker.com cannot replace or refund tickets which are lost, stolen or destroyed.

Please check ticket details before travel, including check-in time. Travel must take place as indicated on the tickets. In all cases, your tickets may not be sent until a few days before your departure date. We reserve the right to arrange for tickets to be collected at the terminal on the day of departure. In the event of delay to scheduled services, please check with your carrier for details of their arrangements. We bear no responsibility for any liability for any such delays. In any case, we advise you to check with port/station/airport authorities before departing.

In the case of operational disruption for any reason, Ferrybooker.com will not be liable for any additional expenses incurred or any other form of compensation. Facilities, entertainment and organised activities may be restricted during off-peak periods. There may be some facilities advertised which cannot be made available as they are subject to weather conditions, volume of support, time of the year or local laws and regulations. Such events are regrettably beyond our control.

HOTEL, CAR HIRE, INSURANCE & EUROTUNNEL BOOKINGS

GENERAL TERMS & CONDITIONS
Ferrybooker.com is a fully licensed travel agent.

The travel arrangements available to Ferrybooker customers include:
i) Arrangements where Ferrybooker acts as a retail agent of the operator - you will be required to comply with the booking terms and conditions of that tour operator.

In these conditions any reference to you means all persons named on the booking including any added or substituted at a later date.

References to we are references to Ferrybooker. Reading these booking conditions forms part of your contract with Ferrybooker.

Please read these booking conditions carefully. On signing the booking form you are deemed to you have read and accepted the Booking Conditions and that you have the authority to accept and are accepting the terms of these conditions on behalf of all persons in the party.

This contract is governed by English Law and both parties agree to submit to the jurisdiction of the English Courts at all times unless you decide to refer to arbitration under clause 11.

1. & 2. YOUR AGREEMENT WITH US

Your contract with us shall come into existence when we issue our confirmation invoice except in the case of bookings made within 8 weeks of departure in which case special conditions apply (see below). When making a booking with us you must complete, sign and return our booking form. You must pay a deposit of £100 per person (excluding infants) plus any insurance premiums. The balance must be paid 8 weeks before departure. If the booking is made within 8 weeks of departure it is deemed to be a late booking and the contract between us comes in to effect upon your confirming to us your acceptance of the arrangements and our receiving payment. In this case the full balance must be paid at the time of booking. If the deposit and/or the balance is not paid in time we may cancel your booking. If the balance is not paid on time, we shall retain your deposit and per the cancellation charges below.

3. PAYMENT AND TICKETS

We accept Visa, MasterCard and Switch cards. A 2% charge is levied on credit card payments.

All travel documents are electronic and will be sent to you by email, on receipt of payment.

4. INSURANCE

It is a condition of this booking that you are adequately insured. If you have not taken Ferrybooker insurance you must have cover at least equal to that of the Ferrybooker Silver Policy.

5. PRICE

Price Guarantee: Our sales consultants will quote the price for your selected itinerary at the time you make your reservation. Once you have paid your deposit and received our confirmation the invoice price of your travel arrangements is fully guaranteed and will not be subject to any surcharge.
We reserve the right however to lower or raise our prices at any time before the booking is confirmed.

6. CHANGES MADE BY YOU

If, after our confirmation invoice has been issued, you wish to alter your travel arrangements in any way we will do our best to help providing that we receive written notification from the lead person on the booking form no less than 42 days before the original departure date.
An amendment fee of £25 per person (excluding infants) will be charged in addition to any charges passed on by our suppliers (e.g. ferries or hotels).
Please note that if the number of persons in a booking changes the price will be recalculated on the basis of the amended party size.
If you wish to change your travel arrangements within 42 days of the original departure date this will be treated as a cancellation of the original booking and cancellation charges will be applied as set out below.

Cross Channel Travel; Eurotunnel, ferry, Seacat. No refunds or amendments are permitted with ticket only offers.

7. CANCELLATION BY YOU

You, or any of your party, may cancel your travel arrangements at any time. Written notification from the lead person on the booking must be received at our offices. You will be required to pay the applicable cancellation charges up to the maximum show below.
Please note that insurance premiums are non-refundable.
Period before departure within which written cancellation received: (Amount of cancellation is as a % of the price for the travel arrangements) Over 42 days Deposit only Between 29 and 42 days 50% Between 15 and 29 days 70% Within 15 days 100% Cancellation charges of 100% of the flight cost will be levied if you have to cancel or make any changes after tickets have been issued (for changes the full price of the flight will have to be paid again even if the same flight is used). This also applies to discounted Business Class fares.

FERRY, EUROTUNNEL CANCELLATION BY YOU
If you decide to cancel your holiday you must email or telephone us. The time of cancellation is taken as the date of telephone call received by us and a fee will be charged depending on the carriers' cancellation conditions.

Insurance premiums are non-refundable. Please ensure that you are in receipt of written confirmation from us of your cancellation. If you are covered by holiday insurance, you may be able to recover these cancellation fees.

8. CHANGES MADE BY US

We plan your travel arrangements many months in advance. Regrettably amendments may sometimes be necessary and errors occasionally occur. We reserve the right to make changes or correct errors at any time both before and after our confirmation. Most of these changes are minor and we will always try to advise you of these changes before you depart if there is time.
Flight timings and carriers advertised may be subject to change for operational reasons. The final details will be shown on your flight tickets and you should check these carefully. If a major change does become necessary however, we will inform you as soon as it is reasonably possible if there is time before your departure. Changes to aircraft type with the resulting lack of facilities promised at the time of booking are deemed to be minor changes.
A major change involves a change of UK airport (with the exception of a change from one London airport to another), destination airport (other than between two airports serving the same city or resort), time of UK departure by more than 12 hours, resort area, in the case of tours and cruises a significant change of itinerary or offering accommodation of a lower standard than originally booked.
If we have to make a major change you have the following options:

a) accepting the altered travel arrangements.
b) Accepting alternative arrangements that we may be able to offer.
c) Canceling your travel arrangements with us without charge.

If you choose c) we will refund all your monies to you and if you choose a) b) c) we will pay compensation to you on the following scale. If you choose b) we will refund any difference in cost of the new arrangements if the new cost is lower but if the new cost is higher than the original booking you will have to pay the difference except where the change arises due to reasons of force majeure.
Compensation per person (excluding infants) is payable as below based on the date before your scheduled departure date when a major change is notified to you More than 56 days Nil 29 to 56 days £10 14 to 28 days £20 Under 14 days £30 Our liability in all cases involving a major change is limited to offering you the above choices and compensation.
Compensation is not payable if we have to make changes for unusual and unforeseeable circumstances, which we could not have avoided even with due, care.
Compensation will not be payable in the case of Force Majeure i.e. if we are forced to cancel or change your travel arrangements in anyway for reasons of war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, adverse weather conditions or other circumstances over which we have no control.

9. CANCELLATION BY US

We reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients that we require for a particular tour or arrangement is not reached, we may have to cancel it. If we are unable to provide the booked travel arrangements you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard, if available. If it is necessary to cancel your travel arrangement compensation will be payable as detailed above.
We will not cancel a booking after the final balance due date unless you fail to pay the balance or in the case of force majeure.

10. IF YOU HAVE A COMPLAINT

If you have a problem during your travel programme it is a legal requirement that you bring it to the attention of the relevant supplier (e.g. your hotelier or airline) as soon as possible. If you are unable to resolve the problem locally you must obtain written confirmation from the supplier of your complaint and follow this up by writing to us within 28 days of your return. Correspondence should be addressed to our Customer Services Department at Ferrybooker.com 2morrow Court, Appleford Road, Sutton Courtenay, OXON, OX14 4FH. Please give your booking reference and all other relevant details. If you fail to follow this procedure we cannot accept liability for any claim.

12. OUR LIABILITY TO YOU

We accept responsibility for ensuring that the travel arrangements you book with us are supplied as described in promotion material and that the services offered reach a reasonable standard. We will always endeavour to ensure that any special requests you may make eg Non Smoking Room are fulfilled, however we can never guarantee such requests. If any part of your travel arrangement is not provided as promised we will pay you appropriate compensation if we agree this has affected the enjoyment of your trip. We accept responsibility for the acts and/or omissions of our employees, agents and suppliers except death personal injury or illness (providing they were at the time carrying out work authorized by us). We accept responsibility should you or any member of your party suffer death personal injury or illness as a result of any failure to perform or improper performance of any part of our contract with you by any of our agents, suppliers or sub-contractors (providing they were at the time carrying out work authorized by us) except where the failure to perform or improper performance was due to:

a) your own acts or omissions
b) those of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable
c) an event which could not have been forseen or avoided even with all due care

Our liability in all cases (except death or personal injury) shall be limited to a maximum of twice the cost of your travel arrangements excluding insurance premiums and amendment fees. However our liability in respect of carriage by air, sea and rail and the provision of accommodation is limited in the manner provided by the relevant international conventions and conditions of carriage. You can ask for copies of these international conventions from our offices.
It is a condition of the acceptance of liability above that you notify us of any claim in accordance with the conditions relating to complaints. Where any payment is made to you or any members of your party that person must assign to us or our insurers any rights they may have to pursue any third party. They must furthermore agree to fully co-operate should our insurers or we wish to enforce those rights.

13. PERSONAL INJURY UNCONNECTED WITH YOUR BOOKED TRAVEL ARRANGEMENTS

If you, or any member of you party, suffer death, illness, or injury whilst overseas arising out of an activity which does not form part of your travel arrangements or an excursion arranged through us, we shall at our discretion, offer advice, guidance and assistance to help you in resolving any claim which you may have against a third party, provided we are advised of the incident within 90 days of its occurrence. Where legal action is contemplated our written consent must be obtained. If the person concerned is successful in obtaining a costs order against a third party or to recoup costs under any insurance policy they may have we shall be entitled to recoup from that person the costs actually incurred by ourselves. Our costs in respect of you and any member of your party shall not exceed a total of £5,000.

14. CONDITIONS OF CARRIAGE

When you travel with a carrier, the conditions of carriage of that carrier will apply, some of which may limit liability. The conditions of carriage of that carrier are incorporated into this contract. You may ask for copies of the relevant conditions of carriage from our offices. This web site is our responsibility, as your tour operator. It is not issued on behalf of, and does not commit the airlines mentioned herein or any airline whose services are used in the course of your travel arrangements. Please note that in accordance with Air Navigation Orders in order to qualify for infant status an infant must be under 2 years of age on the date of return flight.
